Article 26 of the Children`s Act provides for a means by which parents who no longer live together can reach an amicable agreement that allows them both to participate in the upbringing of children. This agreement is called a parental responsibility agreement. Although the law does not define what a parental responsibility agreement is, we understand from practice and context that it is an agreement by which a child`s parents define the boundaries, scope and nature of their co-parenting agreement. Decisions can still be made by consensus, even if they do not meet the parameters of the court order. Please note, however, that these ancillary agreements are not legally binding.
